How Self-Exclusion Works

Everything you need to know about statutory self-exclusion under the National Gambling Act 7 of 2004.

Legal basis

Statutory Framework

Self-exclusion in South Africa is a statutory process, not a voluntary opt-in programme. It is governed by primary legislation and enforceable nationally.

National Gambling Act 7 of 2004

Section 14 creates the right to self-exclusion and requires the NGB to maintain a national register of excluded persons. All licensed gambling operators are legally bound to enforce it.

NGB Form 1/1

The prescribed application form under Government Gazette No. 26994 (12 November 2004). FMSA completes and submits this form on your behalf as your authorised representative.

ECTA Section 13 E-Signature

Your digital signature is legally valid under the Electronic Communications and Transactions Act 25 of 2002. It has the same legal force as a wet signature on paper.

POPIA Protection

All personal information is processed under the Protection of Personal Information Act 4 of 2013. Your data is encrypted, anonymised for research, and retained securely for 5 years.

NGB Form 1/1 (Current Version)

FMSA processes and submits the NGB Form 1/1 as published under Government Gazette No. 26994 (12 November 2004), being the current accepted version. No further amendments to this form have been gazetted. We confirm submission to you by email.

NGB and PGB Enforcement

Responsibility for processing your application, notifying Provincial Gambling Boards, and enforcing your exclusion rests with the NGB and the 9 Provincial Gambling Boards. FMSA submits and follows up on your behalf.

Closing the gap

Digital Blocking as a Complement

Physical self-exclusion and digital blocking serve different functions. Use both for the strongest protection.

Self-Exclusion

Bars you from all licensed physical gambling premises in South Africa. Legally binding and nationally enforced via the NGB register. Free to apply.

Digital Blocking

Blocks access to gambling websites and apps on your devices. Not a legal obligation on operators, but a powerful personal protection tool. FMSA recommends Gamban and BetBlocker.
